We collect, use and process your personal data in accordance with this Privacy Policy and the provisions of the Personal Data Protection Act (Official Gazette No. 103/03, 118/06, 41/08, 130/11, 106/12), and all other personal data protection regulations applicable in the Republic of Croatia.

Our clients’ privacy is very important to us and we make every effort to protect the confidentiality of their data. We therefore kindly request that you read our personal data protection policy from time to time to ensure you are aware of any possible changes.

User Consent and Withdrawal of Consent

Marlex.hr collects the user personal data provided voluntarily by the user. It will be considered that by accepting the Terms of Use Marlex.hr, which includes this Privacy and Data Protection Statement as an integral part, the user gives his/her consent and expressly indicates his/her wish, thus signifying agreement to the processing of personal data relating to him/her for the purpose of using the services offered by Marlex.hr. User consent can be withdrawn at any time based on a written notice submitted to that effect.

Data Controller

Marlex is the controller of your personal data. This Privacy Policy is applicable to all user personal data that we collect and process, either directly or through our partners. “Personal Data” means any information which concerns an identified or, directly or indirectly, identifiable natural person. “Data Processing” means any operation performed on personal data, such as collection, storage, use, inspection, and transfer of personal data. This Policy does not apply to anonymized data. “Anonymized Data” means such data that cannot be attributed to a specific natural person.

What types of data do we collect?

Marlex.hr collects all personal data which are accumulated when users use the services offered by Marlex.hr (via the website), and when they communicate with Marlex.hr. We collect only such personal data that are essential to achieving the purpose for which the users use the services offered, and only to such extent that is necessary to achieve that purpose. In particular: the data which the users provide in our online form or in some other manner while using the services of Marlex.hr-a (e.g. via phone or e-mail), including personal data (e.g. first and last name, address, phone, date of birth, sex, means of payment, etc.), user data which are delivered or automatically generated (e.g. date and time when the service was used, currently and previously used page, IP address, data about the browser used, device code, current location, if provided, etc.), as well as interaction data, if available without installing additional programs in the computer (e.g. when the user moves the mouse or clicks the mouse buttons, or presses keyboard keys while using the website), personal data generated by Marlex.hr or third parties (e.g. passwords), correspondence and other type of communication with the users (e.g. electronic mail, phone conversations, which may be recorded, if needed).

What types of data do we collect?

Marlex.hr may use the data relating to its users collected by itself or in its name for the following purposes:
  • Provision of services offered by Marlex.hr,
  • Preparation of various statistics relating to, for example, the amount of interest shown by the user for a product, a comparison of services, or to other services offered by Marlex.hr,
  • Internal training and quality control,
  • Maintaining and developing the relationship with the client,
  • Guaranteeing the safety and availability of the system and data of Marlex.hr and its service providers,
  • Corporate transactions executed by Marlex.hr that may have an impact on user data,
  • Prevention, detection and curbing all forms of misuse,
  • Providing a response to justified official inquiries or inquiries associated with the process of establishing evidence for legal claims or other legal disputes which either concern or involve Marlex.hr.
Other purposes may arise from particular circumstances or statutory obligations, or be necessary to ensure collection of particular data.

Brochures, Commercial Communication

In connection with the services that it offers, Marlex.hr may from time to time send brochures or other material (of a commercial nature) to the address or number of any user who has registered his e-mail, other electronic address, or mobile phone number with Marlex.hr. By registering such information with Marlex.hr, users give their consent to delivery of the mentioned brochures and material. However, they can inform Marlex.hr at any time and at no cost that they no longer want to receive such brochures or other material, or be notified in that respect.

Will any of my personal data be shared with third parties?

Apart from a few exceptions, as stated below, Marlex.hr in principle does not share any personal data with third parties. However, Marlex.hr may engage a third party to process personal data in the name of and solely for the purpose of business operations of Marlex.hr (e.g. market research agencies). In such cases, Marlex.hr will apply appropriate measures to ensure that the third party concerned processes such data solely in the manner in which Marlex.hr is authorized to process them. Furthermore, Marlex.hr may share personal data with third parties if the user requests so (through registration, request for offer, etc.), if that is necessary to provide the service requested by the user, or if Marlex.hr expressly informs the user of the fact that his/her data will be shared. In exceptional cases (e.g. in the event of misuse), user data may be shared with third parties for purposes other than those stated in this data privacy statement, or such as are required by the law. Marlex.hr cannot control, guarantee or vouch that third parties will comply with the data protection rules applied by Arbona.hr. They process data for their own purposes, possibly also in foreign countries where different regulations are applied. Marlex.hr may also share personal data with third parties if it is required by law to do so. Furthermore, Marlex.hr may share anonymized user data with third parties. The form of such data does not allow identification or it renders identification of the person to which they refer unlikely. All employees and business partners of Marlex.hr are obligated to comply with the privacy protection principles based on the contract signed with Marlex d.o.o and its related companies.

Brochures, Commercial Communication

If user data are stored or processed in some other manner, Marlex.hr will ensure that appropriate technical and organizational measures are applied in order to prevent unauthorized processing or such for which no lawful basis exists. These measures are regularly checked and, if necessary, amended. The obligation to ensure implementation of such measures also applies to third-party system administrators. Personal data are stored in the form that allows user identification, but only to the extent and no longer than necessary in order to achieve the purpose for which they are collected or further processed. We apply various safety measures, including encryption and authentication, to protect and maintain the safety, integrity and availability of your data. Among other, we also apply and maintain the following safeguards:
  • strictly restricted individual access to your data on a “need to know” basis and exclusively for the purpose(s) about which you have been informed,
  • safe transmission of collected data,
  • constant monitoring of the access to IT systems for the purpose of detecting and preventing misuse of personal data.

How long will we keep your personal data?

We will store and process your personal data only for as long as is necessary to achieve a specific legitimate purpose, unless a longer retention period is required by the relevant regulations for a particular purpose. If you consent to the use of your personal data for marketing purposes, we will keep such data until you withdraw your consent. If the offer is refused and the user has not given his consent to the use of his personal data for marketing purposes, the data associated with the offer will be kept for a period of one year. However, if you submit a request for erasure, they will be deleted immediately. The personal data that are no longer needed are either irreversibly anonymized or destroyed in a safe manner.

Questions, Suggestions, Requests for Information, Corrections and Deletions

Users have the right to withdraw the consent to the processing of personal data at any time and to request that their personal data no longer be processed, except for statistical purposes when they no longer allow identification of the data subject. Users may also request that their personal data, which are being processed, be either corrected or modified. onsent withdrawal notices and requests for correction or modification of personal data must be submitted in writing via e-mail to: info@marlex.hr, or by post to the following postal address: Kučanska 24, 42 000 Varaždin. Users may also object to the processing of their personal data for marketing purposes, in which case their personal data will not be processed for that particular purpose. Objections to the processing of personal data for marketing purposes must be submitted in writing either via e-mail to: info@arbona.hr, or by post to the following postal address: Horvatova 82, 10000 Zagreb. All other inquiries, suggestions or comments regarding the processing of personal data are also welcome.

A person who considers that any of his/her rights arising from the Personal Data Protection Act has been violated may submit a request for determining a violation of rights to the Personal Data Protection Agency.
